El Vector de la Tierra en Surf City II y Bitcoin City: ¿Especulación de Salida o Utilidad Real en el Aeropuerto del Pacífico?

A partir de observaciones y sensing de mercado realizados la semana pasada en la franja costera de Oriente, contrastamos las proyecciones teóricas que analizábamos en 2022 con los datos duros de absorción, tarifas y desarrollo físico a junio de 2026, a cuatro años de la promulgación de la Ley Bitcoin y bajo el impacto de la infraestructura logística estatal. El análisis parcial de algunos componentes del sistema inmobiliario en esta región expone tres vectores críticos para la toma de decisiones de inversión institucional:


1. La Paradoja de la Infraestructura y la Renta Ricardiana

El mercado costero muestra una brecha evidente entre el desarrollo con tracción real y la especulación en bruto. Por un lado, observamos comunidades cerradas de segundas viviendas que, gracias al financiamiento de largo plazo por parte de la banca formal, establecen techos de mercado consolidados en torno a los $150 la vara cuadrada (v²). El perfil de este comprador no busca construir de inmediato; adquiere el lote para integrarse y disfrutar de las amenidades y el club de playa privado de la comunidad desde el primer día. Por el contrario, los propietarios de macro-lotes en bruto lejos de El Cuco frente al mar (extensiones de más de una manzana y sin factibilidades de servicios) exigen montos superiores a los $100/v². La matemática financiera desmitifica este precio: al deducir la pérdida de eficiencia de la tierra por urbanización, calles y cesión de espacios, sumado al CapEx de desarrollo, el costo técnico de la vara útil se eleva a los $290/v².


Aquí opera con fuerza la Renta Ricardiana: el precio de la tierra está determinado por su escasez y su capacidad de generar retornos, no por el deseo del dueño. Para que un lote útil de salida calce con la realidad del mercado, un costo de $290/v² en la costa es insostenible si consideramos que un benchmark premium de primera vivienda en el Área Metropolitana de San Salvador, como Madreselva, orbita los $350-$400/v². Por otro lado, si el valor de salida en una comunidad cerrada consolidada frente al mar es de $150/v², la tierra en bruto en segunda fila (en montaña con vista, sin salida al mar) debería valuarse técnicamente entre $10 y $12/v². Al pedir a los desarrolladores entre $25 y $35/v² por esa segunda fila, los propietarios están exigiendo un múltiplo de hasta 3x sobre su valor financiero viable, bloqueando la absorción del mercado final.


2. Micro-operation: El Debate entre el Maximalismo Especulativo y el "Utility Value"

En el plano de la micro-economía turística, se hace evidente la contradicción de visiones que ya sondeábamos en el origen de la ola cripto. Por un lado, la narrativa de figuras como Max Keiser —quien desde la Oficina Bitcoin impulsa la atracción masiva de tecnólogos y autoriza tokenizaciones inmobiliarias— tiende a validar una alta expectativa de apreciación y especulación de los activos. Por el otro, economistas como Jeff Booth (a quien el mismo Keiser trajo a El Salvador, y a quien tuvimos la oportunidad de conocer en su visita al país) sostienen la tesis de que, bajo un Bitcoin Standard, los bienes raíces tarde o temprano caen a su valor de utilidad real (utility value basado en flujos de caja y uso del espacio).


En la práctica, el huésped internacional de alto perfil (High-End Surfer) convalida tarifas premium exclusivamente por la proximidad radical y la consistencia de la ola. El problema surge en la oferta secundaria fuera de la primera línea: hostales empíricos sin frente al mar que intentan sostener tarifas infladas de $70 a $85 la noche basados únicamente en la novedad de la carretera pavimentada, captando una demanda puramente estacional de fin de semana.


Bajo simulaciones financieras con un OpEx estándar del 45%-55% y una ocupación segura del 28% (solo fines de semana), los números de estos operadores colapsan. Se ha vuelto una práctica común el intentar subarrendar la operación del hostal a un tercero para asegurar un flujo pasivo sin trabajar; sin embargo, para que el operador logre rentabilidad, las expectativas de canon mensual de los propietarios requieren un descuento técnico de hasta el 60% sobre lo que piden inicialmente. El mercado frena el arbitraje informal.


3. El Rediseño del Master Plan y el Ordenamiento de la Franja Costera

La mutación del diseño conceptual de proyectos de gran escala como Bitcoin City, migrando de su proyección mediterránea e industrial en las faldas del volcán hacia un esquema costero contiguo al mar, responde a una estricta lógica de Desarrollo Orientado al Transporte (DOT), catalizado por el nuevo Aeropuerto del Pacífico y la conectividad aeroportuaria y vial de flujo rápido.


A menos de 20 minutos de esta infraestructura, la dinámica cambia. A diferencia de los puntos de surf tradicionales caracterizados por lechos de piedra, aquí emergen frentes al mar con amplias playas de arena que atraen un perfil inmobiliario de lujo orientado a estancias prolongadas (long stays). No obstante, la falta de una zonificación estatal clara y estricta genera el riesgo latente de una mezcla desordenada de usos que degrade el ecosistema exclusivo de la zona.


Ante este reto, iniciativas internacionales como la liderada por la coalición Save The Waves —que declaró formalmente a Oriente Salvaje como Reserva Mundial de Surf— se vuelven el estándar técnico a seguir. Al blindar la ola y su entorno bajo criterios de conservación y desarrollo sostenible, se sientan las bases de una zonificación de alta gama. Esta es la clave para que Surf City II capitalice su potencial y no repita los errores de crecimiento urbano desordenado que afectaron la saturación de los nodos en La Libertad.


Conclusión del Laboratorio: 

El inversionista institucional debe suspender el juicio frente a la narrativa mediática superficial. El valor real no reside hoy en la primera fila sobrevalorada de forma empírica, sino en la capacidad de identificar los puntos de enganche de la infraestructura logística y aeroportuaria, aplicando metodologías rígidas de valuación antes del despliegue formal de las Zonas Económicas Especiales (ZEE). El análisis de flujos reales siempre vencerá a la espuma especulativa.

It is important that the new government of Nayib Bukele sends a positive message regarding private participation in sectors such as Geothermal energy. The two previous governments of the FMLN political party caused harm by blocking new concessions through irresponsible and illegal actions by CEL (Executive Hydroelectric Commission. A Government owned company), along with the complicity of MARN (Ministry of Environment and Natural Resources) and SIGET (General Superintendence of Electricity and Telecommunications). They took away livelihoods and dreams from many families. That's why people like myself, who had never spoken about politics or been involved before, started investigating what was happening and actively participating in politics. We promoted the principles of not using the state for personal gain, promoting free competition, and reducing political clientelism and crony capitalism. We realized that what we needed to advocate for was not favors, privileges, or handouts from the state, but rather fair rules of the game for everyone. By studying the Supreme Court rulings on SIGET's (General Superintendency of Electricity and Telecommunications) authority to grant concessions, we learned a lot about the legal aspects of Geothermal energy. We have seen how the FMLN politcal party confused the population and used the argument that the subsurface rights belong to everyone to justify that only the government through CEL Group (Executive Hydroelectric Commission. A Government owned company) can participate in geothermal energy production, despite the laws allowing private participation.



As a partner and General Manager of a company that was a member and administrator of a Geothermal Energy Consortium in El Salvador, I was responsible for directing the Pre-Feasibility studies of a 5 MW Geothermal Project and seeking financing from banks, investors, international geothermal companies, investment funds, and external cooperation. The new Regulatory Law for the Granting of Concessions (LEY REGULADORA PARA EL OTORGAMIENTO DE CONCESIONES DE PROYECTOS DE GENERACION ELECTRICA ENPEQUEÑA ESCALA . August 2013) allowed us to move forward with the project after spending a year in a legal limbo following the Supreme Court ruling. In the end, we realized that neither SIGET (Electricity Superintendency) nor MARN (Minister of Environment) wanted to resolve their contradictions regarding the new law, I believe out of fear and complicity with the FMLN political party leadership, who ideologized the issue of Geothermal energy to support their case of removing the Italians (ENEL) from LaGeo (State Geotherrmal Company) and gaining control of the resource. The FMLN politcal party always dreamt of financing its national and regional political agenda in the style of Chavez (Venezuela President) and his 21st-century socialism. The political right group of El Salvador (congressman, business assocations, and opinion leaders) remained passive on the issue of geothermal energy, perhaps because they were still dealing with the aftermath of the CEL-ENEL legal case (where their members where involved in a constroversial legal case) and wanted to avoid stirring up more controversy after the government (leftist FMLN politcal party government) reached an agreement with ENEL (Italians) to prevent problems with potential affected parties. I had the opportunity to present the obstacles faced by geothermal projects to representatives of the German government through an invitation from SICA (Central American Integration System). Currently, there is financing available for geothermal drilling, supported by the German State Bank, which we could not take advantage of due to the political situation surrounding Geothermal energy that remained unchanged during the FMLN politcal party governments.



It is necessary to rewrite the energy policy formulated by Funes (ex President Funes) through the CNE (National Energy Council) and avoid the contradictions of this policy with government plans, such as those that occurred under the Sanchez Ceren administration (President Sanche Ceren 2014-2019), which aimed to "restore the strategic role to CEL and its subsidiaries" (CEL is the State Owned Energy Company). This marked the beginning of the madness of creating the "Grupo Cel" (A Vertically managed group of state companies that were horizontally managed in the past) an objective that alarmingly I saw mentioned as an advantage for investors in the securitization (investment memorandum) that was carried out to pay the Italians with pension funds (Pay ENEL to leave their stake in the National Geothermal Company).



It should also be clear in the energy policy that CEL (The State Energy Company) is just another participant in the market. The management of ETESAL (The State Company in charge of electricity transmission infraestructure) should be taken away from CEL (the National Energy producer can block competitors from connecting to the energy distribution network) to prevent conflicts of interest and to avoid the temptation of blocking projects from competitors or political enemies of the government. This is a concern for any bank or private investor who is not a sympathizer, member, or financier of the parties that have been in government. I mention this based on how things have historically been, and we hope it will change with the Bukele government. Members of Congress must modify the laws and remove CEL's (The State Energy Company) ability to arbitrarily interpret its Law of Creation (and apply arbitrary eminent domain powers to wipe out competitors). CEL should not succumb to the temptation of using the Expropriation Law from the 1950s to create a state monopoly, as the former president of CEL attempted to do. This is necessary to provide legal certainty for private investments in the geothermal sector.



To attract private investment in geothermal energy, members of Congress must provide an authentic interpretation of Article 18 of the Regulatory Law for the Granting of Concessions for Small-Scale Electricity Generation Projects (LEY REGULADORA PARA EL OTORGAMIENTO DE CONCESIONES DE PROYECTOS DE GENERACION ELECTRICA ENPEQUEÑA ESCALA). It should be made clear that the Ministry of Environment (MARN) can be allowed to approve "GENERAL" Environmental Impact Studies (EIA) to process concessions in the Legislative Assembly. If possible, it should be clarified that the approval does not entitle the developer to request the environmental permit but only to use the approval of the General EIA to process the concession. In this way, the spirit of the Environmental Law is not violated, and it helps avoid claims from other sectors. This will resolve a problem that dates back to 2004 when the SIGET (Superintendency of Electricity) regulations allowed this procedure (General EIA instead of Specific EIA to have the right to ask for the concession), which was later ratified by lawmakers from all parties and became something permitted by the new Concession Law issued by the Legislative Assembly (In August 2013) after SIGET was stripped of the power to grant concessions, which was then given to the Assembly (Congress). Despite the new law, MARN (Ministry of Environment) and SIGET (Superintendency of Electricity) continued to pass the buck between them (one throwed the responsibility to the other) and in this way helped to starve projects to death, like the one in which I invested.



We had to endure the madness of the FMLN political party in the past 10 years, with its consequences directly affecting us. It hurts to know that the political opposition did nothing regarding the abuses of the president of CEL (The National State Owned Energy Company). He even said on television that "CEL has the power to declare important sectors such as Geothermal Energy as being of public utility," a completely irresponsible statement that created an atmosphere of insecurity for private investments in the sector. According to the law, private investors have the right to participate in the sector. What investor or bank would invest their money in a sector where the government acts based on ideology, disregards the laws, and is willing to do anything to prevent competition?



Part of the success that President Bukele's government can achieve in the energy sector lies in making decisions based on technical considerations rather than ideology, regarding the participation of the government, national and foreign private entities in geothermal energy, whichever benefits the country the most in the short and long term. This requires reviewing possible business models and engaging in a public-private dialogue, not situations where the government announces what it is going to do and invites private entities just to listen (one way conversations). Dialogue is dialogue, and it should be a bilateral process, not unilateral.



Below is an analysis I conducted in late 2014 on the government's contradictions in the geothermal energy sector, citing the World Bank's opinions.



CONTRADICTIONS BETWEEN THE FIVE-YEAR PLAN AND THE ENERGY POLICY: A WEAK FOUNDATION FOR PROMOTING RENEWABLE ENERGIES THROUGH THE NATIONAL CLIMATE CHANGE PLAN

The NATIONAL -CLIMATE CHANGE- PLAN, in its component 6 (Renewable Energy Promotion Program, Efficiency, and Energy Security), mentions that the country's competitiveness, based on the efficient use of natural resources and the utilization of clean technologies, requires a strong boost from the components of the NATIONAL ENERGY POLICY (PEN) related to the PROMOTION OF RENEWABLE ENERGIES.



There is a LACK OF CLARITY in the ENERGY POLICY 2010-2024 presented by the previous government (President Funes in 2014) (there was still no update from the government of Sanchez Ceren in 2019 ) and an apparent CONTRADICTION between the ENERGY POLICY 2010-2024 and the FIVE-YEAR PLAN 2014-2019 of President Professor Sanchez Ceren, which creates WEAK FOUNDATIONS for the implementation of the proposed actions in component 6 of the National -Climate Change- Plan (Promote renewable energy):



a) The ENERGY POLICY 2010-2024 states that it is necessary to RESTORE THE STRATEGIC ROLE OF CEL AND ITS SUBSIDIARIES (Cel is the State Owned Energy Company) for the sustainable energy development of the country and in line with the strategic objectives of the State, so that CEL AND ITS SUBSIDIARIES MAINTAIN GREATER COORDINATION WITH THE EXECUTIVE. It also states that the strategic role of CEL and its subsidiary companies should be strengthened, particularly in research, study, PROJECT EXECUTION, and OPERATION OF ELECTRIC POWER GENERATORS USING RENEWABLE SOURCES. Additionally, the Energy Policy 2010-2024 mentions that support for the installation of SMALL RENEWABLE ENERGY GENERATION PROJECTS should be enhanced in an EXTENSIVE manner involving different territorial actors. b) According to the Five-Year Development Plan 2014-2019 of the Government of President Professor Sánchez Cerén and the objectives of a -good life-, which included boosting the national economy to GENERATE OPPORTUNITIES FOR BUSINESSES, there was a line of action that involved PROMOTING AND ATTRACTING NATIONAL AND FOREIGN INVESTMENTS, and within this line of action, strengthening the institutional and legal framework of INCENTIVES to attract and increase foreign and domestic investment. (Source: Five-Year Development Plan 2014-2019, "Productive, Educated, and Safe El Salvador," Technical Secretariat and Planning (STPP), Government of El Salvador, January 2015, Chapter V - Objectives of a Good Life: framework of the five-year programming, Objectives, strategies, guidelines, and goals for the 2014-2019 quinquennium, Objective 1 - Boost the national economy to generate opportunities and prosperity for families, businesses, and the country, Lines of action, E.1.7 Promotion and attraction of national and foreign investments, L.1.7.3 Strengthen the institutional and legal framework of incentives to attract and increase foreign and domestic investment.) Additionally, according to the Five-Year Development Plan 2014-2019 of the Government of President Professor Sánchez Cerén, PRIVATE INVESTMENT WILL BE PROMOTED AND DEVELOPED through guidelines such as increasing levels of national and foreign private investment in strategic productive sectors such as ENERGY, and implementing and fostering the realization of projects under the public-private partnership modality that contribute to economic growth and social well-being of the population. Vice President Oscar Ortiz (and then Sigifredo Reyes) will be responsible for much of this (through PROESA the national promoter of foreign direct investment), as the promotion and attraction of private investment require strengthening and consolidating the Agency for Promotion of Exports and Investments of El Salvador (PROESA) as a promoter of new investments and facilitator of the creation of public-private partnerships. (See: Five-Year Development Plan 2014-2019, "Productive, Educated, and Safe El Salvador," Technical Secretariat and Planning (STPP), Government of El Salvador, January 2015, Chapter VII - Guidelines for fiscal policy, investment, and resource mobilization, E. Guidelines for the promotion and attraction of private investment.)



When the ENERGY POLICY 2010-2024 stated that it was necessary to restore the STRATEGIC ROLE of CEL and its subsidiaries in the sustainable energy development of the country and in achieving the strategic objectives of the State, on the one hand, it did NOT MENTION NOR EXPLAIN THE ROLE OF PRIVATE PARTICIPATION, and on the other hand, when the ENERGY POLICY added that CEL and its subsidiaries should MAINTAIN GREATER COORDINATION WITH THE EXECUTIVE, they gave a COMPETITIVE ADVANTAGE to CEL and its subsidiaries over any private entity wishing to enter the renewable energy market where CEL or its subsidiaries had or seeked to have participation, which also openned the doors to a STATE MONOPOLY. While it was true that some privatizations did not bring the expected benefits to the country in terms of technology transfer and efficiency, and instead, the profits of privatized entities were accounted for in the GDP of other countries, depriving the state of the revenues it used to have, it is necessary to STUDY WITHOUT IDEOLOGIES THE ROLE IN THE MARKET OF PARTICIPANTS SUCH AS CEL AND ITS SUBSIDIARIES, ALBAPETROLEOS (A joint venture between local governments and the Venezuela Oil Company), AND THE PRIVATE SECTOR, and what was best for the renewable sector and the country. When the ENERGY POLICY 2010-2024 stated that the STRATEGIC ROLE OF CEL AND ITS SUBSIDIARIES SHOULD BE STRENGTHENED WITH REGARD TO THE EXECUTION OF PROJECTS AND OPERATION OF ELECTRIC POWER GENERATORS USING RENEWABLE SOURCES, it did not specify whether by saying "strategic role of CEL and its subsidiary companies" it meant a "PREPONDERANT" ROLE??, or if they intended for CEL and its subsidiaries to have a HEGEMONIC AND MONOPOLISTIC ROLE?? in the renewable energy market. The aforementioned situations and their LACK OF CLARITY were a DISINCENTIVE FOR ANY PRIVATE INVESTOR IN RENEWABLE ENERGY. Who would want to compete with a government that is the same one granting permits? On the other hand, THE ROLE OF ALBA PETROLEOS AND ITS SUBSIDIARIES OR RELATED COMPANIES was NOT CLEAR, which were clearly private companies that HAD INFLUENCE IN THE GOVERNMENT, which was a COMPETITIVE ADVANTAGE that no private entity had, and it DISCOURAGED COMPETITION AND INVESTMENT by potential private competitors. Which government official would refuse to help Alba Petróleos? Which official would help a private company that wants to compete with Alba Petróleos or with CEL and its subsidiaries? THERE ARE NO CLEAR RULES, POLICIES, OR GOVERNMENT PRONOUNCEMENTS REGARDING THE ROLE OF THE GOVERNMENT, CEL AND ITS SUBSIDIARIES, ALBA PETROLEOS, AND THE PRIVATE SECTOR, regarding which market niches each one should or can occupy, according to the government's guidelines and support and what is best for the country. Any high-ranking official, even a Minister, would be afraid to support private initiatives that compete against Alba Petróleos or CEL and its subsidiaries out of fear of falling out of favor with the party or with the economic or political interests behind these companies and the officials who managed them. Let's not forget that it is the government's policies that INTERNATIONAL COOPERATION AND DEVELOPMENT BANKS must support and respect, and with this lack of clarity, they cannot support private projects. What cooperating entity would want to support private ventures that competed against Alba Petróleos or Cel and its subsidiaries if they risked falling out of favor with the government or the FMLN pollitical party or with government officials representing these interests? On the other hand, when the energy policy 2010-2024 mentioned that support will be strengthened for the installation of SMALL RENEWABLE ENERGY GENERATION PROJECTS in an EXTENSIVE manner involving different territorial actors, it is mentioned that support will be provided extensively to small projects, but it is not clarified whether this means supporting small projects that are exclusively owned by CEL and/or its subsidiaries, or if they will be projects in which CEL and its subsidiaries must have participation with private entities and/or local governments. All of this generated confusion, insecurity, and increased risks and capital costs for any private entity wishing to venture into large or small renewable energy projects. Regarding the FIVE-YEAR DEVELOPMENT PLAN 2014-2019 of the government of President Professor Sánchez Cerén and its line of action to promote, attract, and encourage national and foreign investments, and to PROMOTE AND DEVELOP PRIVATE INVESTMENT IN STRATEGIC SECTORS SUCH AS ENERGY, this was seemingly contradictory to the ENERGY POLICY 2010-2024 since the Energy Policy aimed to restore the STRATEGIC ROLE OF CEL AND ITS SUBSIDIARIES IN THE IMPLEMENTATION OF RENEWABLE ENERGY PROJECTS. It was necessary for the government and the National Energy Council to clarify the rules of the game between CEL and its subsidiaries, Alba Petróleos, and private entities wishing to invest in renewable energy projects, and for fair competition to exist among them. On the other hand, it was important to note that according to the FIVE-YEAR DEVELOPMENT PLAN 2014-2019, NATIONAL AND FOREIGN PRIVATE INVESTMENT IN ENERGY WILL BE PROMOTED AND DEVELOPED, as well as the implementation and acceleration of projects under the PUBLIC-PRIVATE PARTNERSHIP modality. This could become another obstacle for developers of small projects if this model is required by government policies since implementing Public-Private Partnerships in small projects could make them unviable due to the high costs and waiting times required for a central or local government to decide to invest under this modality using the new Public-Private Partnership law. Finally, it is worth mentioning that as early as 2012, after the government had launched its Energy Policy 2010-2024, the Energy Unit of the Latin America and Caribbean Region of the World Bank, through the Energy Sector Management Assistance Program (ESMAP) and the Geothermal Potential Assessment for Central America, concluded and recommended for El Salvador in their findings and recommendations (Drilling Down on Geothermal Potential: An Assessment for Central America, March 2012, Energy Unit of the Latin America and Caribbean Region of the World Bank, ESMAP, Chapter 5. Conclusions and Recommendations-El Salvador), they stated that El Salvador had a well-defined institutional structure that allowed for a solid prioritization for energy generation through its energy planning process. The assessment mentioned that energy sector planning was the responsibility of the National Energy Council (CNE), which was at that time in the process of contracting the development of the plan. The evaluation stated that whether the CNE was up to the task of developing a well-structured plan remained to be seen, and yet, outsourcing the planning process was a step forward to counteract the dominant presence of the Salvadoran Electricity Company (CEL), which developed hydropower resources, and the new agreement with the CNE provided a more equitable approach that favored other renewables, including geothermal energy (see: Drilling Down on Geothermal Potential: An Assessment for Central America, March 2012, Energy Unit of the Latin America and Caribbean Region of the World Bank, ESMAP, Chapter 5. Conclusions and Recommendations-El Salvador, Point 118). This indicated that the World Bank perceived CEL's dominant position in renewable energy planning as a problem. Furthermore, the World Bank's assessment stated that there was active private sector participation in energy generation, mainly for thermal generation, and in order to promote private sector involvement in geothermal generation, the role of the geothermal state company (La Geo) in developing geothermal prospects needed to be clarified. Specifically, whether it was financially viable for La Geo to continue acting as the sole developer or if the market should be opened to other participants. The assessment mentioned that La Geo was better positioned to lead a master plan due to its experience in conducting the required exploratory work (see: Drilling Down on Geothermal Potential: An Assessment for Central America, March 2012, Energy Unit of the Latin America and Caribbean Region of the World Bank, ESMAP, Chapter 5. GEOTERMIA SALVADOREÑA EN LA NUEVA ERA

Es importante que el nuevo gobierno de Nayib Bukele mande un mensaje positivo respecto a la participacion privada en sectores como la Geotermia. Los dos gobiernos del FMLN hicieron daño bloqueando nuevas concesiones a traves de actuaciones irresponsables e ilegales de la CEL, y la complicidad del MARN y la SIGET; asi nos quitaron el pan de la mesa y los sueños a muchas familias y por eso gente como quien escribe, que nunca en la vida se habia pronunciado sobre politica, ni mucho menos participado, nos involucramos en investigar que estaba pasando y  participamos activamente en politica, promoviendo los principios de no utilizacion del estado de forma patrimonial, la promocion de la libre competencia, y reducir el clientelismo politico y el capitalismo clientelista. Nos dimos cuenta que lo que teniamos que promover era, no que el Estado nos hiciera favores o nos diera privilegios o limosnas, sino que administrara reglas del juego parejas para todos. Estudiando las sentencias de la Corte Suprema sobre la potestad de SIGET de otorgar concesiones, aprendimos mucho sobre la parte legal de la Geotermia, y hemos visto como el FMLN ha confundido a la poblacion y utilizado el discurso de que el subsuelo es de todos para justificar que solo el gobierno a traves de Grupo CEL pueda participar en la produccion de energia geotermica a pesar que las leyes permiten la participacion privada.

Siendo socio y Gerente General de una empresa socia y administradora de un Consorcio de Energia Geotermica en El Salvador, me toco dirigir los estudios de Pre-Factibilidad de un Proyecto Geotermico de 5 Megas y buscar el financiamiento con Bancos, Inversionistas, Empresas Internacionales Geotermicas, Fondos de Inversion y Cooperacion Externa. La nueva Ley Reguladora para el Otorgamiento de Concesiones, nos permitio seguir adelante con el proyecto despues de pasar un año en el limbo sin normativa legal despues de la sentencia de la Corte Suprema. Al final, nos dimos cuenta que ni la SIGET ni el MARN querian resolver sus contradicciones respecto a la nueva Ley, creo por miedo y complicidad con la dirigencia del FMLN que ideologizo el tema de la Geotermia para apoyar su caso de sacar de LaGeo a los Italianos y lograr el control del recurso. El FMLN siempre soño con financiar su agenda politica nacional y regional al estilo de Chavez y su socialismo del siglo 21. La derecha politica (diputados,gremiales y generadores de opinion) permanecio pasiva con el tema de la geotermia creo por tener los pies hinchados por el caso CEL-ENEL y evitar levantar polvo despues que el gobierno llego a un acuerdo con ENEL y evitarse problemas con posibles afectados. Por invitacion del SICA me toco presentar a representantes del gobierno Aleman, los obstaculos que tenian los proyectos geotermicos y actualmente existe financiamiento para perforaciones geotermicas, apoyadas por el Banco Estatal Aleman, que no pudimos aprovechar por la situacion politica de la Geotermia que nunca cambio durante los gobiernos del FMLN. 

Es necesario reescribir la politica energetica que formulo Funes a traves del CNE y evitar las contradicciones de esta politica con los planes de gobierno, como las que hubieron con los del Gobierno de Sanchez Ceren que tenia el objetivo de "devolver el papel estrategico a CEL y sus subsidiarias", con lo cual comenzo la locura de crear el "Grupo Cel", objetivo que  alarmantemente vi mencionado como una ventaja para los inversionistas en la titularizacion que se hizo para pagarle a los Italianos con fondos de nuestras pensiones. 

Tambien debe quedar claro en la politica energetica, que CEL es un participante mas en el mercado, quitarle el manejo de ETESAL a CEL para que no sea juez y parte, y no caiga en la tentacion de bloquear proyectos de la competencia o de enemigos politicos del gobierno, que es el temor de cualquier Banco o inversionista privado que no sea simpatizante, miembro, o financista de los partidos que han estado en el Gobierno. Lo anterior lo menciono por como han sido las cosas historicamente, lo cual esperamos cambie con el Gobierno Bukele. Los diputados deben modificar las leyes y quitarle a CEL la capacidad de interpretar arbitrariamente su Ley de Creacion y que CEL no caiga en la tentacion de utilizar la Ley de Expropiaciones de los años 50 para crear monopolios estatales, como pretendio hacerlo el anterior presidente de CEL. Eso es necesario para crear seguridad juridica a inversiones de privados en el sector Geotermico. 

Para atraer inversion privada a la Geotermia, los diputados deben hacer una interpretacion autentica del articulo 18 de la Ley Reguladora para el Otorgamiento de Concesiones de Proyectos de Generacion Electrica en Pequeña Escala y dejar claro que se permite al MARN aprobar Estudios de Impacto Ambiental de caracter "GENERAL" para poder tramitar concesiones en la Asamblea Legislativa, si es posible, aclarando que la aprobacion no da derecho a solicitar el permiso ambiental sino solo usar la aprobacion del EIA General para tramitar la concesion. Asi no se violenta el espirtu de la Ley de Medioambiente y se evitan reclamos de otros sectores. De esa manera se resolvera un problema que viene desde el año 2004, cuando la normativa de SIGET permitia este procedimiento (EIA General en vez de EIA Especifico para poder pedir la concesion), que despues fue ratificado por los diputados de todos los partidos y se convirtio en algo permitido por la nueva LEY de Concesiones que emitio la Asamblea despues de quitarle la potestad a SIGET de otorgar las concesiones y se la dio a la Asamblea. A pesar de la nueva Ley, el MARN y la SIGET siguieron tirandose la pelota entre ellos y ayudando a matar por inanicion los proyectos como en el que yo inverti.   


Tuvimos que aguantar las locuras del FMLN estos ultimos 10 años, con sus consecuencias que nos afectaron directamente. Duele saber que la oposicion no hizo nada respecto a los atropellos del presidente de CEL. El llego a decir en television que "La Cel tiene una potestad de declarar de utilidad publica sectores importantes como es La Geotermia...", una declaracion totalmente irresponsable y creando asi un clima de inseguridad para inversiones privadas en el sector, que segun la Ley, pueden y tienen derecho a participar en el sector. Que inversionista o que Banco invierte su dinero en un sector en donde el Gobierno actua en base a ideologia y no respeta las Leyes y esta dispuesto a cualquier cosa para no dejar entrar a nadie a competir?

Parte del exito que podra tener el Gobierno del Presidente Bukele en el tema de energia, sera tomar decisiones de manera tecnica y no ideologizada, respecto a la participacion del Gobierno, de los Privados Nacionales y Extranjeros, en la Geotermia, segun le convenga mas al pais, a corto y largo plazo. Esto pasa por revisar los modelos de negocio posibles, y por un dialogo publico privado, y no eventos en donde el gobierno anuncie lo que va a hacer e invite a los privados a escuchar. Dialogo, es dialogo, y debe ser bilateral y no unilateral.  

A continuacion un analisis que hice a finales de  2014 de las contradicciones del Gobierno en el tema de la Geotermia, citando opiniones del Banco Mundial. 



CONTRADICCIONES ENTRE EL PLAN QUINQUENAL Y LA POLITICA ENERGETICA: UNA BASE DEBIL PARA PROMOVER LAS ENERGIAS RENOVABLES A TRAVES DEL PLAN NACIONAL DE CAMBIO CLIMATICO

El PLAN NACIONAL DE CAMBIO CLIMATICO en su componente 6 (Programa de promoción de energías renovables, eficiencia y seguridad energética) menciona que la competitividad del país, basada en la eficiencia en el uso de recursos naturales y en la utilización de tecnologías limpias, exige del impulso enérgico de los componentes de la POLITICA ENERGETICA NACIONAL (PEN), relacionados con la PROMOCION DE ENERGIAS RENOVABLES.


Existe una FALTA DE CLARIDAD en la POLITICA ENERGETICA 2010-2024 presentada por el anterior gobierno (Funes en 2014) (aun no existe una actualización por parte del gobierno actual-de Sanchez Ceren-)  y una aparente CONTRADICCION de la POLITICA ENERGETICA 2010-2024 con el PLAN QUINQUENAL 2014-2019 del Profesor Sánchez Ceren, lo cual genera BASES DEBILES sobre la cual se puedan implementar las acciones propuestas en el componente 6 del Plan Nacional de Cambio Climático (Promover la energía renovable):

a)La POLITICA ENERGETICA 2010-2024 dice que hay que DEVOLVER EL PAPEL ESTRATEGICO A CEL Y SUS SUBSIDIARIAS en función del desarrollo energético sustentable del país y en función del cumplimiento de los objetivos estratégicos del Estado; de forma tal que CEL Y SUS SUBSIDIARIAS MANTENGAN UNA MAYOR COORDINACION CON EL EJECUTIVO. Además dice que debe fortalecerse el papel estratégico de CEL y sus empresas subsidiarias principalmente en lo que respecta a la
investigación, estudio, EJECUCION DE PROYECTOS y OPERACION DE GENERADORAS DE ENERGIA ELECTRICA QUE UTILIZAN FUENTES RENOVABLES. Además, la Política Energética 2010-2024 menciona que se potenciará el apoyo a la instalación de PEQUEÑOS PROYECTOS DE GENERACION DE ENERGIA RENOVABLE de manera EXTENSIVA en la que participen diferentes actores territoriales. (Fuente: Política Energética Nacional de El Salvador 2010-2024, Consejo Nacional de Energía CNE, 4.Líneas Estratégicas de la Política Energética, 4.2.Fortalecimiento de la Institucionalidad del Sector Energético y Protección al Usuario, Fortalecimiento de CEL y sus Empresas Subsidiarias.)

b) Según el PLAN QUINQUENAL DE DESARROLLO 2014-2019 del Gobierno del Profesor Sánchez Ceren y los objetivos del buen vivir, dentro de los cuales esta dinamizar la economía nacional para GENERAR OPORTUNIDADES A LAS EMPRESAS, existe una línea de acción que es la PROMOCION Y ATRACCION DE INVERSIONES NACIONALES Y EXTRANJERAS y dentro esa línea de acción esta fortalecer el marco institucional y legal de INCENTIVOS para atraer e incrementar la inversión extranjera y nacional. (Fuente:PLAN QUINQUENAL DE DESARROLLO 2014-2019 PQD 2014-2019,EL SALVADOR PRODUCTIVO, EDUCADO Y SEGURO,Secretaria Técnica y de Planificación (STPP),Gobierno de El Salvador, Enero 2015,Capitulo V-Los objetivos del buen vivir: marco de programación quinquenal,C.Objetivos, estrategias, lineamientos y metas del quinquenio 2014-2019,Objetivo 1-Dinamizar la economía nacional para generar oportunidades y prosperidad a las familias, a las empresas y al país, Líneas de accion,E.1.7.Promoción y atracción de inversiones nacionales y extranjeras,L.1.7.3. Fortalecer el marco institucional y legal de incentivos para atraer e incrementar la inversión extranjera y nacional.). Además, según el PLAN QUINQUENAL DE DESARROLLO 2014-2019 del Gobierno del Profesor Sánchez Ceren, se FOMENTARA Y DESARROLLARA LA INVERSION PRIVADA a partir de lineamientos como elevar los niveles de inversión privada nacional y extranjera en sectores productivos estratégicos como ENERGIA e implementar y dinamizar la concreción de proyectos bajo la modalidad de los ASOCIOS PUBLICO-PRIVADOS, que contribuyan al crecimiento económico y bienestar social de la población. El Vice-Presidente Oscar Ortiz (y hoy Sigifredo Reyes) serán responsables de mucho de ello ya que en las líneas para la promoción y atracción de inversión privada se estipula que hay que fortalecer y consolidar a la Agencia de Promoción de Exportaciones e Inversiones de El Salvador (Proesa) como impulsora de atracción de nuevas inversiones y facilitador de la creación de asocios públicos-privados. (ver: PLAN QUINQUENAL DE DESARROLLO 2014-2019 PQD 2014-2019,EL SALVADOR PRODUCTIVO, EDUCADO Y SEGURO, Secretaría Técnica y de Planificación (STPP),Gobierno de El Salvador, Enero 2015,Capitulo VII-Lineamientos de política fiscal, inversión y movilización de recursos,E.Lineamientos para la promoción y atracción de la inversión privada.)


Cuando la POLITICA ENERGETICA 2010-2024 dice que hay que DEVOLVER A CEL Y SUS SUBSIDIARIAS EL PAPEL ESTRATEGICO en función del desarrollo energético sustentable del país y al cumplimiento de los objetivos estratégicos del Estado, por un lado NO MENCIONA Y NO EXPLICA EL PAPEL DE LA PARTICIPACION PRIVADA, y por otro lado, cuando la POLITICA ENERGETICA añade que CEL y sus subsidiarias deben MANTENER UNA MAYOR COORDINACION CON EL EJECUTIVO, le dan una VENTAJA COMPETITIVA A CEL Y SUS SUBSIDIARIAS SOBRE CUALQUIER PRIVADO que desee incursionar en el mercado de energía que utiliza fuentes renovables y donde CEL o sus subsidiarias posean participación o deseen mas participación, lo cual también abre las puertas para un MONOPOLIO ESTATAL. Si bien es cierto que algunas privatizaciones no trajeron los beneficios esperados al país en cuanto a transferencia de tecnología y eficiencia, y lejos de eso, hacen que las utilidades de los entes privatizados se computen en el PIB de otros países, habiendo despojando al estado de ingresos que antes tenía, es necesario ESTUDIAR SIN IDEOLOGIAS EL ROL EN EL MERCADO DE LOS PARTICIPANTES COMO CEL Y SUS SUBSIDIARIAS, ALBAPETROLEOS Y LOS PRIVADOS Y EL ROL DEL ESTADO CON RESPECTO A ESTOS PARTICIPANTES y que es lo que conviene más para el sector de las renovables y el país. Cuando la POLITICA ENERGETICA 2010-2024 dice que debe FORTALECERSE EL PAPEL ESTRATEGICO DE CEL Y SUS SUBSIDIARIAS EN LO QUE RESPECTA A EJECUCION DE PROYECTOS Y OPERACION DE GENERADORAS DE ENERGIA ELECTRICA QUE UTILIZAN FUENTES RENOVABLES, no se especifica si al decir "papel estratégico de CEL y sus empresas subsidiaras", se refiere a un PAPEL "PREPONDERANTE"??, o si pretenden que CEL y sus subsidiarias tengan un PAPEL HEGEMONICO Y MONOPOLICO?? en el mercado de energía que utiliza fuentes renovables. Las situaciones antes mencionadas y su FALTA DE CLARIDAD son un DESINCENTIVO PARA CUALQUIER INVERSIONISTA PRIVADO EN ENERGIAS RENOVABLES. Quien quiere competir con un gobierno que es el mismo que otorga los permisos? Por otro lado,NO ESTA CLARO EL PAPEL DE ALBA PETROLEOS Y SUS SUBSIDIARIAS O EMPRESAS RELACIONADAS, que a todas luces son empresas privadas que POSEEN INFLUENCIA EN EL GOBIERNO, lo cual es una VENTAJA COMPETITIVA que ningún privado tiene y DESINCENTIVA LA COMPETENCIA Y LA INVERSION por parte de potenciales competidores privados.Que funcionario de gobierno se negara a ayudar a Alba Petróleos? Que funcionario ayudara a una empresa privada que quiera competir con Alba Petróleos o con Cel y sus subsidiarias? NO EXISTEN REGLAS, NI
POLITICAS, NI PRONUNCIAMIENTOS GUBERNAMENTALES CLAROS RESPECTO AL PAPEL EN EL MERCADO DEL GOBIERNO, CEL Y SUS SUBSIDIARIAS, ALBA PETROLEOS, Y LOS PRIVADOS, respecto a cuáles son los nichos de mercado que cada uno debe ocupar, o puede ocupar según las líneas y apoyos del
gobierno y conveniencia para el país. Cualquier funcionario de alto nivel, incluso un Ministro, tendrá miedo de apoyar iniciativas privadas que entren a competir contra Alba Petróleos o contra Cel y sus subsidiarias por el miedo a caer en desgracia con el partido o con los intereses económicos o políticos detrás de estas empresas y de los funcionarios que las manejan. No olvidemos también que SON LAS POLITICAS DE GOBIERNO, las que la COOPERACION INTERNACIONAL Y BANCA DE DESARROLLO Y MULTILATERAL DEBEN APOYAR Y RESPETAR, y CON ESTA FALTA DE CLARIDAD NO PUEDEN APOYAR PROYECTOS PRIVADOS. Que cooperante querrá apoyar a privados que compitan contra Alba Petróleos o Cel y sus subsidiarias si corre el riesgo de caer en desgracia con el gobierno o con el FMLN o con los funcionarios de gobierno que representan estos intereses? Por otro lado, cuando la política energética 2010-2024, menciona que se potenciará el apoyo a la instalación de PEQUEÑOS PROYECTOS DE GENERACION DE ENERGIA RENOVABLE de manera EXTENSIVA en la que participen diferentes actores territoriales, se menciona el apoyo a Pequeños Proyectos de manera EXTENSIVA, y no se aclara si significa que se apoyara pequeños PROYECTOS PEQUEÑOS CUYO PROPIETARIO SERA CEL y/o sus subsidiarias exclusivamente, o si serán proyectos en los que debe haber participación de CEL y sus subsidiarias con privados y/o gobiernos locales. Todo esto genera confusión, inseguridad, y aumenta los riesgos y costos de capital a cualquier privado que desee incursionar en proyectos grandes o pequeños de energía renovable. Respecto al PLAN QUINQUENAL DE DESARROLLO
2014-2019 del Gobierno del Profesor Sánchez Ceren y su línea de acción de promover,
atraer, e incentivar inversiones nacionales y extranjeras, y FOMENTAR Y DESARROLLAR INVERSION PRIVADA EN SECTORES ESTRATEGICOS COMO ENERGIA, esto es aparentemente CONTRADICTORIO CON LA POLITICA ENERGETICA 2010-2024, ya que la Política Energética tiene como objetivo DEVOLVERLE EL PAPEL ESTRATEGICO A CEL Y SUS SUBSIDIARIAS EN EJECUCION DE PROYECTOS QUE USEN ENERGIA RENOVABLE. Es  NECESARIO QUE EL GOBIERNO Y EL CNE ACLAREN LAS REGLAS DEL JUEGO ENTRE CEL Y SUS SUBSIDIARIAS, ALBAPETROLEOS Y PRIVADOS que quieren invertir en proyectos de energía renovable y que exista una competencia justa entre ellos. Por otro lado, es importante anotar que según el PLAN QUINQUENAL DE DESARROLLO 2014-2019 se FOMENTARA Y DESARROLLARA LA INVERSION PRIVADA NACIONAL Y EXTRANJERA EN ENERGIA y en implementar y dinamizar la concreción de proyectos bajo la modalidad de los ASOCIOS PUBLICO-PRIVADOS. Esto podría convertirse en otro obstáculo para desarrolladores de pequeños proyectos, si esta figura es exigida por las políticas de gobierno, ya que realizar Asocios Publico Privados en proyectos pequeños podría hacerlos inviables debido a los altos costos y tiempos de espera que debe cumplirse para que un gobierno central o local decida invertir bajo esa modalidad utilizando la nueva ley de asocios publico privados.


Finalmente, cabe mencionar que ya en 2012, después de que el gobierno había lanzado su Política Energética 2010-2024, la Unidad de Energía de la Región de Latinoamérica y el Caribe del BANCO MUNDIAL (Energy Unit of the Latin América and Caribbean Region of the World Bank) a través del Programa de Asistencia a la Administración del Sector de Energía (Energy Sector Management Assistance Program ESMAP), y una Evaluación para Centro América para el aprovechamiento del Potencial Geotérmico (Drilling Down on Geothermal Potential: An Assessment for Central America), en sus conclusiones y recomendaciones sobre El Salvador (Drilling Down on Geothermal Potential: An Assessment for Central America,March 2012,Energy Unit of the Latin America and Caribbean Region of the World Bank,Energy Sector Management Assistance Program (ESMAP),Chapter 5. Conclusions and Recommendations-El Salvador.), decía que El Salvador tenía en ese entonces una bien definida estructura institucional que permitía una priorización solida para la generación de energía a través de su proceso de planeamiento energético. Mencionaba la evaluación, que la planeación del sector energético era la responsabilidad del CNE, que estaba en ese momento contratando el desarrollo del plan. Decía la evaluación que si el CNE estaba a la altura de la tarea de desarrollar un plan bien estructurado, eso era algo que estaría por verse, y sin embargo, tercerizar el proceso de planeamiento era un paso al frente para CONTRARRESTAR LA PRESENCIA DOMINANTE DE CEL, que desarrolla recursos hídricos y el nuevo acuerdo con el CNE proveía UN ABORDAJE MAS EQUITATIVO QUE FAVORECIA OTRAS RENOVABLES, incluyendo la geotermia. Aquí se puede ver que el Banco Mundial percibía como problema esa posición dominante de CEL en el tema de la planeación de las energías renovables. Además la misma evaluación del Banco Mundial decía que existe una participación activa en la generación de energía de parte del sector privado, principalmente para generación térmica, y que en orden de promover la participación privada en la generación geotérmica, EL ROL DE LA GEO EN DESARROLLAR PROSPECTOS GEOTERMICOS DEBE SER CLARIFICADO. Específicamente SI ES FINANCIERAMENTE VIABLE QUE LA GEO CONTINUE EN ACTUAR COMO UNICO DESARROLLADOR O SI EL MERCADO DEBIA SER ABIERTO A OTROS PARTICIPANTES. La evaluación mencionaba que La Geo estaba mejor posicionada para conducir un plan maestro debido a su experiencia para conducir el trabajo exploratorio requerido.(ver:Drilling Down on Geothermal Potential: An Assessment for Central America,March 2012,Energy Unit of the Latin America and Caribbean Region of the World Bank,Energy Sector Management Assistance Program (ESMAP),Chapter 5. TIPOS DE ACTIVOS DE CAPITAL INMOBILIARIO



Para crear una politica de inversion inmobiliaria siempre se definen primero los tipos de activos en los que uno va invertir.

Vengo de la industria de Corretaje de Inmuebles. Desde 1992 y durante 15 años, trabaje en Corretaje de Inmuebles y en el año 2007, me hice socio de una Desarrolladora de Inmuebles.

Uno se va conociendo mejor a traves del tiempo y cada vez que me pregunto donde puedo agregar mas valor a quienes sirvo, es sacando ventaja de mi capacidad de analisis y mi pensamiento estrategico, y por eso decidi que la administracion de inversiones inmobiliarias es lo mio.

La Administracion de Inversiones le da a uno la autoridad para tomar decisiones de inversion y el exito depende del rendimiento promedio que uno pueda lograr para el activo o el grupo de activos que uno administra.

La experiencia me hizo fuerte en la parte comercial y para la administracion de inversiones aprendi algo fundamental, que es usar la simple logica financiera que me enseño mi padre: "la tasa de retorno que uno busca y los flujos de efectivo que un activo puede producir, son los que definen el precio que uno puede pagar por ese activo". En los 80's, el era un Gerente de lo que hoy se conoce comunmente como un Family Office, donde administraba inversiones de diverso tipo. Siempre me contaba una que otra anecdota de cuando fue uno de los fundadores de la primera Bolsa de Valores, que le entendi dejo de existir,  y recuerdo bien cuando se formo la segunda despues de los acuerdos de Paz.

Cambiar la cachucha de Corredor a Administrador de Inversiones, implica ver los mercados en que uno trabaja, de maneras diferentes.

Como Agente o Broker Inmobiliario, uno actua vendiendo, comprando o alquilando inmuebles para otros. Uno trabaja en el mercado de espacios inmobiliarios. Como administrador de inversiones, uno trabaja en los mercados de activos de capital inmobiliario. Y como desarrollador inmobiliario, uno crea el link entre el mercado de espacios y los mercados de activos de capital.

En el Corretaje, las propiedades compiten entre si. En la administracion de inversiones, las propiedades, vistas como activos de capital, y subyacentes a estos activos, compiten contra otros activos de capital, ya sea en los mercados publicos o privados,  en forma de Deuda, Participacion (Acciones), en mercados locales o globales, y plazos cortos, medianos o largos.

Para crear una politica de inversion, uno debe poder establecer comparaciones de rendimiento entre los activos que pretende adquirir y las otras opciones que existen en el mercado. Uno debe conocer los productos que ofrece la competencia.

Por cuestiones legales, un administrador de inversiones debe ser muy cuidadoso en definir su ambito de accion. La ley del Mercado de Valores no limita a nadie a operar como administrador de inversiones. Lo que uno no puede nunca hacer, es captar fondos del publico. 

A continuacion, una tabla que puede ser muy util para diferenciar los mercados de Activos de Capital y los tipos de activos de capital:



Debo agregar que los Tipos de Activos de Capital Inmobiliario pueden llamarse tambien "Productos de Inversion" (Investment Products), "Tipos de Instrumentos", o "Clases de Valores", del sector inmobiliario, y se pueden dividir en Valores/Titulos Inmobiliarios (Real Estate Securities), Valores emitidos en procesos de titularizacion, Bienes Inmuebles (Real Property), Participaciones Privadas Inmobiliarias o Acciones de Sociedades que invierten en el sector inmobiliario y no cotizan en Bolsa, Prestamos Hipotecarios, etc. Esta division o clasificacion es util en el momento en que uno crea una politica de inversion y relaciona estos activos con respecto a otros activos y fuentes de ingresos de los clientes o de los inversionistas (aplica la teoria de portafolios) y cuando uno mide los riesgos de exposicion en el sector inmobiliario segun la estructura o vehiculo utilizado para invertir.  

Por ahora, me parece atractiva la administracion de inversiones de Capitales Privados.

Con el tiempo y a medida que se desarrollen los Fondos de Inversion, se iran abriendo oportunidades de trabajar con Capitales Publicos.

Risk, Ego and Community

I have been surfing since I was 14 years old. I was always distracted at school because I learnt quickly. I was considered intelligent in my class, but not fond of rules. It was an advantage I was not born in the ADD Era, because I would have been medicated.

When I was 18 years old and graduated from school I got the support of my dad to start my first serious small business venture where I would be in charge all by myself. I created a goat farm that was a model visited by university students, but failed to sell it's products. In one year I sold the farm to a Salvadorean that lived abroad and it was a succesfull real estate deal. In 1991 we bought at 80k with 15k down, invested 30k, and sold for 140k. Total investment of 45k plus interests, and we sold for 140k in 1 year!. The buyer offered me a work/study stay at his house in downtown L.A. and that is how I ended in a real estate license course in 1992.

When I was a teenager surfing was all about radical moves, $400 buck surfboards which I could hardly afford, aerials, and the fit body, tan, clothes, and bully persona. Beyond the common surfer archetype I just mentioned, there were moments that I could  predict when the waves were big just by feeling the wind and looking at the sky in the city. There was something that called me to go surfing and I used to find big waves when I followed my instincts.

I left my surfer persona in 1993, and stopped partying ever since at 21. I kept surfing less and less and when I was 33 I hardly hit the beach. I had becomed obssesed with work, suits, the "I don't have time for nothing" attitude and a business persona. I worked at a Bank and became CEO of our real estate association.

It always hurt me a lot when people did not understand when I was trying to do things they thought I was not qualified for. Who are you to think you can do that? What is your track record? What resources do you have? What is your experience?

The need for beeing accepted kept me from embracing my whole potential as an entrepreneur. I changed surfboards for the hard working man archetype and thought I was beeing a good boy.

Excess work, worry, fear,insomnia,pressure, the sense of beeing responsible for so many things that were not in my hands started to pass the bill to my health in my late 30's and early 40's.

3 years ago I decided to surf again, I started to invest time in surfing and good food, time with my family near nature, and that first year, my productivity changed, I saw how a project we had been having problems to develop sold easily it's second phase. I have ever since been recovering my health, step by step, wave by wave and investing in myself and my family. I made a bet for a better future with my wife and consciously brought to life our second daughter.

I now feel the urge to surf big waves. I have surfed the biggest swells that have arrived to our country in the past couple of years. When I tell people of my urge to surf bigger waves, I still feel hurt when they tell me I am not qualified.


I have experienced that when you surf big waves and risk your life, your ego dissapears. All those people you don't communicate with suddenly become your friends and you start caring for the others life and feel the sense of beeing safer if you see somebody around. A true sense of community. There are still stronger and better surfers but there is no time for ego. I like that. It is man and nature. The survival of the fittest.

When I am out there alone, with big waves that could drown me, I see the faces of my daughters and my wife, and I think I have to be there for them, I have to survive, I have to return home. I have no option. No margin for error. Crazy. Yes. But that experience always makes me rebirth and know what is really important.

I am starting to realize that to find my true potential and call I need to hang out with others that need to surf big waves. Surfers that are willing to train and go for that big wave. The same in business. I need to go out there and surf big projects, and be part of those who are willing to risk it all and be part of that business community. That has always been my call and will always be. I am an opportunistic investor. I risk my life everyday. Legal agreements, promises, are all bullshit in some cases; they are breached and broken. They are mere formality. A must. They reduce risk, yes, but are not the essence of business. It is only the trust in life that I will obtain my returns that lets me go further. The end game. I can see and foresee risks in complex situations, I am good at it, but when I think about my family, fear of failure must be overcomed. I must go on. I need to survive. I need to be there for them, even with the risk of loosing everything.

I am always figuring out how to add value in the long term to the projects I manage and invest in. Some people say I am stupid investing in risky projects and not obtaining nothing in the short term. But that is the way I am. I am long term greedy. 

I injured my leg almost two months ago. I got beaten up in the waves one day and did not give up. I went back the next day. I got my injury. I have experienced pain in the past days, and I am about to win big or fail big in some business. But that is how I am. 

                     Sourcing deals yesterday. 

My plan is to recover from my injury and prepare myself for bigger waves. I LIKE BIG WAVES AND BIG PROJECTS!!

Fondos de Inversion, REITS y Titularizacion

Alla por 1997, me presto un trabajo de Fideicomisos el Dr. Francisco Barrientos, padre del primer departamento de Fideicomisos del Banco Cuscatlan, quien lo habia elaborado y guardaba celosamente en su escritorio.

Por esa epoca yo leia tambien la historia del desarrollo de los mercados de capital de EUA. En los 70's los fondos de Pension de EUA demandaron administradores de inversiones especializados para poder invertir en diversos sectores y asi es como nacen los Fondos de Inversion Inmobiliarios, los REITS, y otros vehiculos legales modernos para inversionistas institucionales. Los Bancos incluso, se convirtieron algunos en empaquetadores de hipotecas y  administradores de cartera, obteniendo asi mas liquidez.

Cuando trabaje en el Banco Cuscatlan entre el 2000 y 2004, cotize con una firma de abogados de Panama y propuse al Banco crear un fondo de inversion para sacar los activos extraordinarios de los Balances del Banco y desarrollar y vender los activos emproblemados.

Vi, estudie y di seguimiento a las primeras propuestas de Ley de Fondos de Inversion.

Por alla por el 2009 fui director de programa de la Global Housing Foundation, quien en conjunto con UN-HABITAT y Merril Lynch crearon un programa interesante de Titularizacion de Hipotecas para ofrecer $200 millones de dolares para compra de hipotecas en todo el mundo, con una garantia de $50 millones de parte de UN-HABITAT para todas las emisiones que se hicieran (25 por ciento de garantia!! ...mas la casa).

En Agosto de 2016 firme mi primer contrato de administracion de inversiones, que incluia la posibilidad de crear un Fondo de Inversion o un Fideicomiso para el manejo de las inversiones.

Y aqui estoy en Costa Rica en 2017, 2 decadas despues de mi primer contacto con el tema fiduciario en 1997, a punto de comenzar el Congreso de Fideicomisos, Fondos de Inversion y titularizacion y conocer a los expertos fiduciarios de la region.

El futuro esta aca!

TRAFICO HORRIBLE: CONSTRUIR HACIA ARRIBA O HACIA LA PERIFERIA?

San Jose y San Salvador tienen problemas de congestionamiento vehicular. Serios. En San Salvador, veo dificil resolver esto, incluso con transporte colectivo moderno. Poco factible ensanchar las calles. El ciudadano comun quiere "salir" hacia la periferia, buscando aire y menos trafico. El mayor reto de un desarrollador es darle a sus clientes opciones donde vivir, trabajar y estudiar sin trafico y sin contaminacion.
Todo indica que las fuerzas centrifugas crean una demanda natural en la periferia, que justifica crear nuevas ciudades donde se pueda vivir, trabajar y estudiar, en el mismo lugar, pero crear estas nuevas ciudades requiere una gran masa de recursos financieros, tierra, infraestructura y construccion en grande. A principios de 2015, investigue las cifras de poblacion del Municipio de San Salvador, que indicaban que San Salvador se esta "vaciando" de habitantes. Es dificil revertir esta tendencia.
Existe tambien la alternativa de construir hacia arriba en la capital, cerca de los colegios, centros de trabajo y transporte publico moderno existente o planeado y que este conecte rapidamente con la periferia y otros puntos dentro de la ciudad. El reto es que esta alternativa no aparta a los habitantes del trafico,el humo y el ruido, y los costos de la tierra para los desarrolladores son generalmente altos y dificultan obtener las tasas de retorno requeridas. Hay que ser creativos y construir cada vez mas pisos, comprar bien, crear Micro Climas (traer el campo a la ciudad) e invertir en renovacion urbana, que no cuesta cinco. De que se puede, se puede.
Mi apuesta respecto a la oferta de productos finales en la periferia, es que para que puedan ser competitivos con respecto a los mas centricos y de la ciudad, es que deben venderse a un 15 o 20 por ciento menos para compensar el costo adicional del commute a los clientes, si estos salen a vivir a la periferia y se tardan, por ejemplo, 30 minutos mas que antes.
